Proposed New RABS Bill will fail Constitutional muster

RABS FailTo fail “Constitutional muster” means that something does not comply with the laws set forth in the Constitution.

The attached document states the opinion of Advocate C van Jaarsveld of the Groenkloof Chambers in response to the Association for the Protection of Road Accident Victims (APRAV) who has requested an opinion regarding the potential unconstitutionality of the latest Bill introducing the Road Accident Benefit Scheme (RABS) as a substitute to the current system of compensation put in place by the Road Accident Fund Act 56 of 1996.
